Things to Know About Mediation and Your Child Custody Determinations

About a year ago, I started focusing on understanding legal concepts because of some legal trouble I was having at work. It was really discouraging to be left dealing with the idea that my entire future could be decided by a single judge, but I knew that I had to do something to make things right. I started working with a professional lawyer to understand what I was facing, and it was fascinating to learn more about the law. I wanted to create a website all about focusing on legal concepts to help other people who might be facing legal trouble.

If you are going to be getting divorced and you have children with your spouse, then child custody is going to be the most important subject covered and decided upon during the divorce proceedings, it's often also the most heated subject. Mediation can be a good way to work out child custody if you and the other parent can complete the process successfully. Here are things to know about mediation.

You should discuss mediation with your lawyer

When you are going to be going through the mediation process, you want to discuss things with your lawyer first. Even though the mediation won't take place in a courtroom, discussing things with your lawyer will prove to be important for various reasons. You can ask your lawyer questions you have so you feel more prepared as you go into the process. Your lawyer can also give you advice they feel is important and that they want you to be well aware of. Since your lawyer is someone watching out for your best interest and they know the legal system, they are going to be invaluable as you head into the mediation process.

You should follow some helpful tips

There are some things you should do to help the mediation go a bit smoother. The better prepared and clear you are, the better you may find your mediation goes.

One of the things you can do is to figure out how you feel custody should go while being realistic and compromising. Set out some different options on a printed monthly calendar, so you can present those options during the mediation. If things go well, then you may have just put together the custody and visitation portion with very little effort and hassle.

Give and take with financials

When it comes to the financial aspect of the children, you should be willing to give and take to ensure it is fair and most of all that your children will have everything they need, no matter which parent they are sharing time with. For example, if you are going to be paying for their medical insurance, then you can suggest your spouse pay for their schooling.

Be professional

When you go into mediation, you will be doing so with a lot of emotions. However, stay professional and don't let your emotions be easy to spot. If you spend the time in mediation crying or raising your voice, then you aren't going to be able to properly cover things with the proper thought and attention put into them.
